Nike Account Terms and Conditions
As an authorized distributor of Nike to the tennis specialty market, Fromuth Racquet Sports is obligated to comply with their policies regarding internet sales. If we are your Nike supplier, it is for your retail shop only. You are prohibited from selling Nike on Amazon, eBay, or any other internet site. If it is determined that you are violating this policy, we cannot supply you, per our agreement with Nike.
ORDERS: All orders are subject to acceptance by Fromuth Racquet Sports, an appointed distributor of Nike product. The minimum dollar amount for any opening order of a new account or new season is $1,000.00 - $200.00 of which is footwear. The minimum units per style and color are 3.
PRICES: Prices are subject to change without notice. Orders will be invoiced at the prices prevailing at the time of shipment.
TERMS OF SALE: Payment for all Nike goods sold through Fromuth Racquet Sports will be due and payable to the terms and conditions stated on the Fromuth Racquet Sports invoice.
BACKORDERS: All shipping charges for backorders will be the responsibility of the customer.
REORDERS: There will be no minimum order on reorders. There are no minimum units per style on reorders.
SHORTAGES: Customer will be responsible for checking its shipment upon delivery for total carton count and condition. All shortages must be reported to the Nike Sales Division at Fromuth Racquet Sports within 30 days from the date of Fromuth's invoice.
RETURNS: Returns will only be considered for merchandise purchased within 30 days of the invoice date. Returns will be accepted for any of the following reasons:
1. Damaged goods: must be a manufacturers defect.
2. Incorrect style, size or color.
3. Any returns based on incorrect sizes or colors having been shipped by Fromuth Racquet Sports must be made within 10 days of receipt of package.
INTERNET / MAIL ORDER POLICY: Nothing contained herein shall be construed to grant the account the right to sell the products contained herein over the Internet or through mail order.
These terms and conditions are not effective in hands other than those for whom they are intended, as determined by Fromuth Racquet Sports and Nike, Inc, and do not constitute an offer to sell.
